Applying for Letters of Administration in Australia


If a person in Australia dies with a will, then the executors named in the will [usually] need to apply to the Supreme Court for a Grant of Probate. If a person dies without leaving a will, or the will is not valid, then someone (usually the closest relatives) can apply to the Supreme Court of the relevant state or territory to be the administrator of the estate. This process is called applying for  a Grant of Letters of Administration. Each state or territory has different laws and rules about who is entitled to share in the estate.
